Association News 2007 CTAA Conference and Trade Show
The Connecticut Apartment Association is proud to announce that our 2007 Fifth Annual Tradeshow was the biggest and best show that the association has held to date. The seminar line up for the 2007 show was truly impressive! CTAA went above and beyond to bring the level of quality much higher than previous years. The association had a phenomenal array of local and national speakers that brought a higher level of educational opportunities to the show’s 335 attendees. Our Keynote Speaker, former Governor John Rowland brought a powerful and moving motivational message that had the audience members both laughing and in tears. Leah Brewer of Full House Marketing taught our property manager and leasing agent attendees about different ways to increase occupancy in her fast paced and energetic seminar. The Landlord Law Firm gave an intriguing session on problem tenants and how best to handle the problematic situation. Our maintenance professional attendees also learned a great deal about personal safety equipment from Roto-Rooter’s seminar and from Clean Sweep Restoration Services about the impact of mold and the standards of remediation so that properties are safe and healthy for tenants to enjoy.
CTAA also had a terrific array of vendors exhibiting on the tradeshow floor - with the number topping out at 59 exhibitors. The association would like to thank all those that participated and sponsored! We hope to see you again next year!

Ann Emerson CTAA Past President Regional Manager, Equity Residential
How did you enter the multifamily industry? I started as a property manager 10 years ago for a 168 residential units in Enfield CT. At that time, I was newly married, and was looking to start a new career- I had spent the 6 years prior in hotel and restaurant management. I was seeking an opportunity to still be able to work with the public, but in a field that offered better hours than some of the late nights I was used to.
What led to your current position? When the company I started with was purchased by Equity Residential in 2000, I was retained by Equity, and my opportunity for growth flourished. I quickly became a manager of 432 units, than a general manager of 820 units within 3 separate communities in central CT. From there it was just waiting for a local opportunity to become a regional manager with the company that had done so much for my success, in the career that I had grown to love.
What made you want to volunteer with CTAA? I had been doing a lot of business with vendors that were a big part of the start up of the CTAA. I was thrilled at the chance to get to meet and network with so many other colleagues and vendors in this business. I could not help but to be thrilled with the chance to be a small part of this huge vision of growing this organization into the well known association it is today.
What do you hope to accomplish with your service to CTAA? or Do you have a vision of what you would like CTAA to become? The CTAA has grown every year in membership and response since it's inception; continuing at that clip would be a lasting accomplishment for all of us involved. I would love to see more members be active with the board, it's an experience that creates lasting friendships and camaraderie throughout the industry.

TO: NAA Members FROM: Betsy Feigin Befus, Vice President, Employment Policy and Special Counsel RE: FCC Order on Exclusive Contracts with Video Providers DATE: November 26, 2007 . On October 31, 2007, the Federal Communications Commission (FCC or Commission) announced a unanimous decision that retroactively bans the enforcement of “building exclusivity” (i.e., building access clauses) between apartment properties and most video service providers.1 Specifically, the Order bans the enforcement of any contract provision between an apartment owner and a covered video service provider that grants the provider an exclusive right to make video services available on the property. “Exclusivity clauses” are defined by the FCC to include those contract terms that would prohibit other providers from accessing the building. The Order does not cover inside wiring, exclusive marketing agreements or bulk billing arrangements.
The Order was released November 13, 2007 but has not yet been published in the Federal Register. Note that the Order is retroactive, so it applies to both existing and future contracts. A copy of the Order is available at http://hraunfoss.fcc.gov/edocs_public/attachmatch/FCC-07-189A1.pdf.
Overview On March 22, 2007, the FCC issued a Notice of Proposed Rulemaking (NPRM) requesting public comment on whether it should regulate exclusive access agreements between providers of video programming services and apartment owners and managers.2 Among other things, the NPRM sought input on whether the FCC has legal authority to regulate in this area, the prevalence of exclusive access agreements, and the benefits and harms to both consumers and video competition attributable to those contracts. The FCC’s NPRM was apparently initiated in response to claims by several large telecommunications companies that have begun to offer video services to residents of “multiple dwelling units” (MDUs) that exclusive access agreements improperly interfere with market competition and consumer choice.
It is important to note that the Order only prohibits the enforcement of exclusive access clauses, not entire contracts covering items beyond exclusive access rights. Specifically, the Order does not prohibit contract clauses that grant exclusive marketing rights. It also does not prohibit granting an exclusive right to use inside wiring owned by the property. Finally, the Order applies only to video service providers; it does not prohibit exclusive access agreements between property owners and service providers offering voice or Internet access.
